Digital Health

Leading the way to wellness through digital healthcare.

As innovative technologies transform the delivery of healthcare services, Husch Blackwell's digital healthcare consultants are on the front line in advising clients on the attendant regulatory and legal issues. We help digital healthcare clients stay up-to-date on the laws regarding protected health information (PHI), intellectual property, regulatory concerns, and more. Our digital healthcare consultants assist healthcare clients with identifying opportunities in the implementation, licensing, and management of their technologies, as well as the challenges involved in protecting their data and patients’ privacy.

Our guidance to clients in the digital health sector includes:

Data privacy, security, and breach response

The use of digital medications, home-based medical devices, electronic patient medical record portals, wearables, and mobile apps creates additional compliance requirements, potential for security and privacy breaches, and liability concerns. Our attorneys advise on risk assessment and mitigation, training and education, compliance, data breach notification, and crisis management.

Licensing and software

The Husch Blackwell team negotiates and protects software and technology licensing for our digital healthcare clients. We protect their interests when they acquire and implement technology, and we provide counsel on critical issues of compliance, intellectual property, privacy, and security.

Telemedicine

Our digital healthcare consultants advise hospitals, clinics, and physician groups on emerging telemedicine opportunities and help ensure their telemedicine services comply with federal and state requirements. Reimbursement, patient privacy, risk management, and credentialing are other common areas of guidance.

Representative Experience

  • Negotiate and draft professional contracts, guidelines, and service agreements for electronic intensive care units (eICUs) and for providers using telemedicine to expand their outreach efforts for patient care.
  • Assist telemedicine clients in navigating state requirements and standard of care issues.
  • Counsel healthcare providers on licensure issues for direct-to-patient and remote monitoring telemedicine business models.
  • Provide fraud and abuse guidance and compliance counseling for healthcare providers with multistate footprints, including Anti-Kickback Statutes, physician self-referral laws, fee-splitting rules, healthcare marketing, and corporate practice of medicine.
