Warehousing & Ports

Supporting the infrastructure that supports our supply chain.

Husch Blackwell’s Transportation industry group understands the intricacies of warehousing and port law as they pertain to the dynamic world of cargo and supply chain management. Our dedicated Warehousing & Ports team is committed to providing unparalleled services to warehousers, carriers, and logistics providers. With in-depth knowledge and practical experience in warehousing operations law, we ensure that clients’ systems, whether involving permanent storage or storage in transit, remain legally robust and operationally efficient.

Our practice boasts an extensive background in drafting, revising, and consulting on an array of critical documents and contracts that are the lifeblood of transportation law. We’re highly knowledgeable regarding the nuances of the Uniform Self-Service Storage Facility Act, various state laws and regulations, and the Uniform Commercial Code, Article 7.

We’re also staunch advocates when disputes arise. Whether it’s a straightforward dispute over a warehouse service agreement or a complex international cargo loss claim, we are extensively experienced with litigation in the warehouse space.

Our representation extends to warehousers engaged in both intrastate and interstate transportation, as well as international shipping activities. We understand that the efficiency and legality of warehousing processes are fundamental to the success of larger supply chain operations.

  • Defended carriers and warehouses in claims pertaining to loss or damage that occurred to goods during storage-in-transit or permanent storage, including dismissal of claims under the Carmack Amendment as preempted.
  • Represented carriers and warehouses in numerous UCC lien auctions when customers have failed to pay for transportation and storage charges incident to transportation. Provided legal notices and publications to ensure commercially reasonably auction procedures are followed. Settled several claims for unpaid transportation and storage fees for amounts far greater than would have been achieved through auction procedures.
  • Represented warehouse authorized to store USDA grade products in suit over storage of bug infested product and customer’s failure to remove the product in a timely manner, warranting destruction of the product pursuant to oral contract.
  • Favorably settled litigation over missing goods at fulfillment warehouse when warehouse was sold to client and existing customer made misleading claims about the amount and value of goods in inventory.
