Husch Blackwell secured a precedential win in a U.S. International Trade Commission (ITC) baby carrier case, representing two of three baby carrier makers cleared of trade and patent infringement charges by rival manufacturer LilleBaby.
The judge ruled that the patent is unenforceable due to "egregious" inequitable conduct before the U.S. Patent and Trademark Office, and that Husch Blackwell's clients’ products do not infringe the patent. The judge also found the patent invalid in light of prior art. The case, filed by LilleBaby in March 2019, initially accused more than 20 baby carrier manufacturers of violating Section 337 of the Tariff Act by importing products into the U.S. that infringe two patents.
