Manufacturing Client Obtains Favorable Rulings in Lawsuit Alleging Breach of Contract

Michael Hayes obtained rulings on combined summary judgment and in limine motions, resulting in a complete win for our client in a case pending in state court in Chicago. Husch Blackwell’s manufacturing client had been sued by a former distributor of its products on a large project in a foreign country, alleging breach of contract, fraud, and tortious inference and seeking several million dollars in damages. 

Just five days before trial, the Court granted our client’s motions excluding all of plaintiff’s damages evidence and ruling in our client’s favor on all claims. Further, the Court granted summary judgment in our client’s favor on its counterclaim (for goods sold to the plaintiff but never paid for) and also held that our client is entitled to recover its attorneys’ fees from the plaintiff.
