Overview

A commercial and labor and employment litigator, Amanda enjoys fitting the puzzle pieces together for clients facing complex disputes.

Amanda represents clients at all phases of litigation at the state, federal and appellate court levels. She guides clients from initial investigation and strategy through motions, briefs, pleadings, discovery, arbitration, trial and – when necessary – appeal. Appreciated for her clear, proactive communication, Amanda has built a reputation for her ability to distill complex information into a format clients can easily understand. She works closely with clients to ensure that individual business goals intersect with legal strategy as she streamlines remedies regarding:

  • Business disputes
  • Breach of contract
  • Breach of fiduciary duty
  • Construction disputes
  • Labor and employment matters

While Amanda represents clients in a wide variety of matters, she has a special focus on labor and employment issues. Amanda is fascinated to work in an area so driven by civil rights and current events and is passionate about helping companies formulate policies, trainings and procedures to protect both themselves and their employees. Keeping business goals in mind, Amanda provides proactive advice to help clients develop employment policies that guard against future costly litigation. When litigation is unavoidable, Amanda represents clients in proceedings filed in state and federal courts and administrative agencies involving allegations of discrimination and harassment.

Before joining the firm, Amanda worked in the non-profit sector, providing both direct services and overseeing licensing issues at a foster care agency. She is deeply motivated by helping others and brings this inherent drive to each case and every client.

Experience

Employment

  • Attained dismissal of lawsuit brought in U.S. District Court, District of Nebraska, against large Nebraska manufacturing plant alleging age discrimination claims.
  • Attained dismissal of lawsuit brought in U.S. District Court, District of Maryland, against one of the nation's largest ethanol producers, alleging discrimination on the basis of disability in violation of the Americans with Disabilities Act (ADA).
  • Responded to numerous charges of discriminations filed with the Nebraska Equal Opportunity Commission, alleging discrimination on the basis of race, age, sex, religion, national origin and retaliation, resulting in "no reasonable cause" findings.

Commercial Litigation

  • Obtained motion to dismiss in U.S. District Court, Central District of Illinois, on behalf of one of the nation's largest ethanol producers, dismissing our client from trade secrets misappropriation lawsuit after presenting unrebutted evidence proving a lack of personal jurisdiction. Court found arguments persuasive, indicating "Plaintiff has done little other than show that some subsidiaries do some business in the state, which courts have repeatedly affirmed is not enough." Dismissal allowed our client to avoid significant additional time, effort and expense associated with a lengthy discovery process.

Clerkship Experiences

  • Conducted research and analyzed federal and state law for various civil and criminal matters in federal court including, but not limited to, motions to suppress evidence, motions for summary judgment and motions in limine.
  • Drafted orders, findings and recommendations on a variety of civil and criminal issues, including matters implicating the U.S. Constitution, Federal Rules of Civil Procedure, Federal Rules of Criminal Procedure and various other state and federal laws.
  • Assisted with in-camera review of potentially privileged and/or confidential documents.
