Overview

With a deep understanding of healthcare law, Andrew focuses his practice on helping clients in the hospice, palliative care, home health, and PACE sectors.

Andrew helps to lead the firm’s coast-to-coast Hospice & Palliative Care Team, working with clients on a broad range of healthcare regulatory compliance and payment issues, including those related to Medicare and Medicaid regulations, provider enrollment and licensing rules, and fraud and abuse laws like the False Claims Act and Anti-Kickback Statute. Andrew and the team also help navigate clients through a wide range of Medicare and Medicaid audits and claim review; 60-Day Repayment Rule investigations; facility, physician, and payor contracting issues; and transactional and corporate restructuring matters.

Andrew primarily focuses his practice on serving post-acute care providers, in particular hospice providers, palliative care providers, home health agencies (HHAs), and Programs of All-Inclusive Care for the Elderly (PACE). He advocates for clients so they can stay focused on their patient care missions.

Clients appreciate Andrew’s background as in-house counsel for the Wisconsin Hospital Association. In that position, Andrew handled contracting, compliance, governance, and healthcare policy matters, including issues related to HIPAA and data privacy, telehealth, and meaningful use of electronic health records.

Experience

Healthcare Experience

  • Counseled two provider clients through complicated Medicare repayment investigations that resulted in reductions in potential overpayment liability of approximately $18 million and $4.5 million, respectively.
  • Navigated numerous provider clients through other complex internal healthcare fraud and 60-Day Repayment Rule investigations.
  • Counseled provider client on submitting OIG self-disclosure to settle potential violation of Anti-Kickback Statute.
  • Advised multiple hospice, palliative care, and home health providers on Medicare and Medicaid provider enrollment requirements, including successfully navigating clients through Medicare deactivation and other adverse enrollment determinations.
  • Led clients receiving contractor claim denials through the labyrinthine Medicare administrative appeals process, including advocating for clients at the redetermination, reconsideration, and administrative law judge phases of appeal.
  • Ushered numerous provider clients successfully through regulatory due diligence efforts for a variety of transactions (buy-side and sell-side) and corporate restructurings.
  • Drafted and negotiated various complex healthcare agreements for or with hospices, palliative care providers, PACE organizations, hospitals, nursing homes, assisted living facilities, physicians, physician groups, and a wide variety of healthcare vendors.
  • Counseled and led hospice client through contract negotiation process with large payor for the provision of hospice and palliative care services to Medicare Advantage beneficiaries.
  • Counseled clients during the COVID-19 pandemic on Provider Relief Fund use and reporting requirements and new Medicare telehealth rules.
  • Advised numerous providers clients on healthcare data privacy laws, including HIPAA breach notification requirements.

Association Counsel

  • Led public policy development efforts related to telehealth, electronic health records, trauma care and emergency preparedness.
  • Coordinated development and execution of plan for Wisconsin to adopt interstate licensure compact, ensuring ability of out-of-state nurses to continue practicing in-state.
  • Led negotiation of complex cloud migration contract.
  • Drafted and reviewed employee handbook policies and counseled human resources director on employment practices.
  • Drafted corporate bylaws and resolutions, and advised senior management on governance and other legal issues.
Outside the Office

Andrew keeps busy with his growing household.

Andrew and his wife, Alena, enjoy spending time with their infant (Mickey), two dogs (Lucy and Stone), and cat (Rufus). When he’s not changing diapers, Andrew enjoys trying new restaurants, traveling, weightlifting, and working around the house (as his limited handyman skills permit).
