Overview

An experienced trial and appeals lawyer, Dan offers clients extensive experience in toxic tort, product liability and mass tort matters.

Dan is involved in all aspects of assisting clients with toxic tort, asbestos, premises liability and product liability claims in state and federal courts. Dan’s experience includes representing manufacturers, suppliers and contractors as lead counsel at discovery, alternative dispute resolution, trial and appeal. Dan also has handled significant litigation for clients in matters of public contracting, construction, as well as labor and employment.

In addition to his career in private practice, Dan was a member of the U.S. Army, Judge Advocate General's (JAG) Corps, where he focused on government procurements matters.

Experience

Prior to joining Husch Blackwell, Dan was involved in the following significant litigation:

Represented contractor defendant in one of nation's first virtual jury trials conducted remotely. Robert Fenstermacher v. 3M Company, et al. Alameda County Superior Court.
Obtained significant victory for employer before U.S. Court of Appeals, Ninth Circuit in Freeman v. Oakland Unified School District (9th Cir. 2002) 291 F3d 632, in EEOC discrimination matter.

Outside the Office

Originally from Nebraska, Dan enjoys spending time outdoors. He maintains a large vegetable and flower garden. A former competitive swimmer, Dan has participated in numerous rough water swims throughout Northern California including the annual San Francisco Bridge swim.

Community Leadership

For more than 10 years, Dan has volunteered his time and legal skills to the U.S. Court of Appeals, Ninth Circuit, Pro Bono Program, representing pro se parties in immigration matters and other complex appeals.
