Overview

An experienced litigator and advisor, Lorinda helps clients resolve compliance concerns, government investigations and disputes, both in and out of court.

Lorinda is a member of the firm's Healthcare, Life Sciences and Education industry teams. In addition to defending companies, institutions and individuals in government investigations and litigation, she often serves as first point of legal contact charged with developing legal strategies, conducting risk assessments, training on compliance issues and providing guidance for related employment matters.

For more than 25 years, Lorinda has drawn on her litigation experience to advise and represent clients both in and out of the courtroom. Lorinda began working in the healthcare field early in her career, defending clients in malpractice lawsuits and medical board actions, and now regularly represents healthcare industry clients in a variety of contexts, including False Claims Act, Texas Medicaid Fraud Prevention Act, and qui tam related investigations and lawsuits, audits, and in business disputes in state and federal court. She uses this experience to advise and train on a variety of compliance issues, including HIPAA compliance. Her experience in healthcare has also led to the education field, including a focus on the legal challenges faced in academic medicine.

A Win for Providers Who Took a Stand

When a local physician group contracted with a management company, they ensured the agreement protected their independent medical decision making and protected their group from solicitation of their employed providers. But promises were broken, so the providers took a stand against the corporate practice of medicine, for themselves and for the safety of their patients. Lorinda and her team litigated the case for years and then, following a two and half week jury trial, secured a multi-million dollar verdict for their client.

  • Resolved False Claims Act case against seller of dental insurance soon after filing robust motion to dismiss, causing relator to voluntarily dismiss certain claims.
  • Resolved False Claims Act retaliation, breach of contract and tort claim case against physician practice group after filing two targeted motions to dismiss.
  • Resolved malpractice and billing fraud claims against psychologist prior to suit being filed and provided guidance on related medical board licensing issues.
  • Advised university of medicine and science on multiple aspects of research misconduct investigation.
  • Updated university's research misconduct policies and procedures to bring them into compliance with federal law.
  • Successfully defended skilled nursing facility in jury trial of employment retaliation and discrimination claims.
  • Assisted school district's counsel with response to Texas Medicaid Fraud Control Unit's investigation of billing for School Health and Related Services (SHARS) not rendered and with HHSC-OIG self-disclosure of overpayments received as a result of billing mistakes.
  • Negotiated voluntary dismissal of whistleblower's False Claims Act case against home health care company and guided internal investigation of allegations.
  • Defended hospital system named in False Claims Act litigation primarily against hyperbaric oxygen treatment provider and guided internal investigation to assess potential risk based on vendor relationship.
  • Responded to series of Civil Investigative Demands issued by Texas Civil Medicaid Fraud Division to hospitals and skilled nursing facilities regarding alleged kickbacks in transportation-related billings and conducted internal investigations related to potential risk.
  • Defended qui tam False Claims Act case arising from alleged false claims submitted to federal workers compensation program, resulting in settlement and dismissal.
  • Successfully defended and resolved numerous medical malpractice cases against various healthcare providers, including hospitals, skilled nursing facilities, emergency physician groups and individual providers.
  • Represented skilled nursing facility in response to Civil Investigative Demands regarding behavioral health services provider and secured reimbursement of expenses through enforcement of contractual indemnity provision.
  • Represented skilled nursing facility in DOJ investigation of employment of OIG-excluded person and in dispute with medical director over allegations of noncompliance with Anti-kickback statute.
  • Achieved motion to strike and motion for summary judgment for private, for-profit university, when former student sued for breach of contract and fraudulent misrepresentation following dismissal from university accreditation program.
  • Represented physician-owned hospitalist practice in a suit for breach of contract, tortious interference with existing contracts, and conspiracy to tortiously interfere with existing contracts.
